that the money, credit, property, a credit card contribution as
provided by subsection (c) of this subtitle, or other financial
assistance will be used for a charitable purpose, ORGANIZATION,
OR CAUSE. It includes:

(1)  An oral or written request;

(2)  An announcement to the news media for further
dissemination by it of an appeal or campaign seeking
contributions from the public for one or more charitable
purposes.

(3)  The EXCEPT WHERE THE SERVICES ARE PURCHASED BY A
CHARITABLE ORGANIZATION OR PROVIDED TO A CHARITABLE ORGANIZATION
AS A PUBLIC SERVICE, THE distribution, circulation, posting, or
publishing of any handbill, written advertisement, or other
publication which, directly or by implication, seeks
contributions by the public for one or more charitable purposes;
and

(4)  The sale of, or offer or attempt to sell OR
SECURE, any advertisement, PATRON LISTING, advertising space,
book card, tag, coupon, device, magazine, membership,
subscription, ticket, admission, chance, merchandise, or other
tangible item in connection with which (i) an appeal is made for
contributions to one or more charitable purposes, or (ii) the
name of a charitable organization is used or referred to, WHETHER
EXPRESS OR IMPLIED, as an inducement to make such a purchase, or
(iii) a statement is made that the whole or any part of the
proceeds from the sale is to be used for one or more charitable
purposes. A solicitation is deemed to have taken place when the
request is made, whether or not the person making it actually
receives a contribution.

(K) "SOLICITOR" MEANS ANY PERSON WHO FOR A FINANCIAL
CONSIDERATION SOLICITS OR RECEIVES CONTRIBUTIONS FOR OR ON BEHALF
OF A PROFESSIONAL SOLICITOR WHICH HAS BEEN ENGAGED BY A
CHARITABLE ORGANIZATION TO RAISE FUNDS ON ITS BEHALF.

103B.

(a) Every charitable organization located in this State
which intends to solicit contributions within or without this
State, or every charitable organization which intends to solicit
contributions within this State or to have funds solicited on its
behalf shall, at least 30 days prior to making any solicitation
or authorizing or allowing a solicitation to be made on its
behalf, file a registration statement AND FINANCIAL REPORT with
the Secretary of State upon forms prescribed by [him] THE
SECRETARY OF STATE. Thereafter, if the charitable organization
intends to engage, or does engage, in solicitation, a RENEWAL
registration form AND FINANCIAL REPORT shall be filed within
three months of the close of each fiscal year in which it so
intends or does engage in solicitation. The president, chairman,
or other principal officer of the charitable organization is
