CHAPTER 781

(House Bill 1559)

AN ACT concerning

State Officers and Employees - Criminal Matters

FOR the purpose of clarifying that the reimbursement authorized
for a State officer or State employee in connection with a
criminal investigation or charge is limited to reasonable
counsel fees.

BY repealing and reenacting, with amendments,

Article - State Government

Section 12-314 and 12-315(a) , 12-315(a), and 12-317

Annotated Code of Maryland

(As enacted by Chapter ____ (S.B. 50) of the

Acts of the General Assembly of 1984)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - State Government

12-314.

Subject to the limitations in this Part III of this
subtitle, the Board of Public Works may reimburse a State officer
or State employee for reasonable [expenses] COUNSEL FEES that the
officer or employee incurred:

(1)  in connection with a criminal investigation into
conduct as an officer or employee if the investigation has
concluded and criminal charges have not been filed against the
officer or employee; or

(2)  in defending against criminal charges that
related to conduct as an officer or employee if final disposition
of all of the charges does not result in a plea of nolo
contendere, a guilty plea, or a finding of guilt.

12-315.

(a) The Board of Public Works may not provide reimbursement
under this Part III of this subtitle unless:
