the applicant.] INSURANCE AND MAY REQUEST A CERTIFICATE TO ACT AS
AN AGENT OR BROKER OR BOTH.
(d) An individual who meets the qualifications prescribed
by this subtitle shall be eligible for a [license] CERTIFICATE as
agent in the kind or kinds of insurance for which the individual
has qualified; and if qualified in the various kinds of insurance
stated in § 168(c) OF THIS SUBTITLE the individual shall be
eligible for license as a broker.
(e) [The qualification as to the same kind or kinds of
insurance shall remain in full force and effect until and unless
suspended or revoked by the Commissioner regardless of the
licenses which may from time to time be issued to the individual;
provided that the] THE Commissioner may require an examination to
establish the competency of an individual [who for three years
preceding the date of his application has held no license as to
the kind or kinds of insurance for which he desires to be
licensed.] WHOSE CERTIFICATE HAS BEEN TERMINATED UNDER § 170(C).
In cases where the license has been suspended or revoked as
provided in § 175, the Commissioner may in his discretion require
the applicant to pass an examination AND FILE A NEW APPLICATION
before reinstatement.
(F) ANY PERSON WHO HAS MET THE CONDITIONS OF QUALIFICATIONS
SET FORTH IN THIS SECTION AND IN §§ 177 AND 178 ON JUNE 30, 1985
WILL BE PRESUMED TO HAVE MET THE QUALIFICATION PROVISIONS.
(G) AN APPLICANT FOR ANY EXAMINATION SPECIFIED IN THIS
SUBTITLE SHALL FILE THE APPLICATION FEE SPECIFIED IN § 41 OF THIS
ARTICLE.
177.
Individual applicants for CERTIFICATE OF qualification as to
kinds of insurance other than life and health insurance and
annuities shall be required to comply with the requirements of
this section, as follows:
(2) The Commissioner shall require such applicant to
satisfactorily pass a written examination relating to the
specific kind or kinds of insurance or subdivisions of them for
which he desires to [be licensed,] RECEIVE A CERTIFICATE for the
purpose of determining his competence with regard thereto. Such
examination shall be given by the Commissioner at least once
every [thirty] 30 days at such times and places as the
Commissioner may determine. The applicant shall pay to the
Commissioner a fee of [fifteen dollars ($15)] $15 for each
examination. An applicant failing to attain a passing grade after
[three] 3 trials shall be required to wait [three] 3 months from
the date of his last previous trial before applying again, and
failing to pass after [six] 6 times, shall be required to wait
[one] 1 year from the date of his last previous trial before
applying again. ANY PERSON WHO HAS TAKEN AND FAILED TO PASS AN
EXAMINATION IS NOT ENTITLED TO TAKE ANY FURTHER EXAMINATION UNTIL
