3550                                         LAWS OF MARYLAND                                     Ch. 759

WHEREAS, Rising energy prices have placed the most serious
burden on the elderly and other low income people; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 95 - Treasurer

(b) (3) THE INTEREST OR INCOME FROM ANY INVESTMENT BY THE
TREASURER OF ANY MONEY OF THE ENERGY OVERCHARGE RESTITUTION TRUST
FUND SHALL BE CREDITED TO THAT TRUST FUND ACCOUNT.

Article - Natural Resources

TITLE 13. ENERGY OVERCHARGE RESTITUTION TRUST FUND

13-101.

IN THIS TITLE "TRUST FUND" MEANS THE ENERGY OVERCHARGE
RESTITUTION TRUST FUND.

13-102.

THERE IS AN ENERGY OVERCHARGE RESTITUTION TRUST FUND.

13-103.

(A) THERE SHALL BE CREDITED TO THE TRUST FUND:

(1) ALL REFUNDS RECEIVED BY THE STATE FROM ANY SOURCE
AS A DIRECT OR INDIRECT RESULT OF LITIGATION AND ADMINISTRATIVE
PROCEEDINGS PROSECUTED BY THE UNITED STATES DEPARTMENT OF ENERGY
TO REDRESS VIOLATIONS OF FEDERAL PETROLEUM PRICING REGULATIONS,
PURSUANT TO THE EMERGENCY PETROLEUM ALLOCATION ACT, 15 U.S.C. §§
751-756 (1973) AND THE ENERGY POLICY AND CONSERVATION ACT, 15

U.S.C. §§ 757-760H (1975); AND

(2) ALL REVENUES RECEIVED BY THE STATE FROM ANY
SOURCE AS A GIFT TO THE STATE, AS DEFINED IN ARTICLE 1, § 22 OF
THE CODE, FOR THE PURPOSE OF PROVIDING OIL OVERCHARGE RESTITUTION
OR ENERGY ASSISTANCE OR WEATHERIZATION TO INDIVIDUALS IN THIS
STATE.

(2) ALL REVENUE THAT IS RECEIVED AND ACCEPTED AS A
GIFT BY THE STATE PURSUANT TO ARTICLE 1, § 22 OF THE CODE, THAT
IS EXPRESSLY GIVEN FOR THE PURPOSE OF ENERGY ASSISTANCE OR
WEATHERIZATION FOR INDIVIDUALS IN THIS STATE.

(B) EXPENDITURES UNDER THIS SUBSECTION SHALL BE MADE
PURSUANT TO AN APPROPRIATION APPROVED BY THE GENERAL ASSEMBLY IN
THE ANNUAL STATE BUDGET, OR BY THE BUDGET AMENDMENT PROCEDURE
PROVIDED FOR IN ARTICLE 15A, § 8E OF THE CODE.
