AN ACT concerning
Consumer Protection - Automotive Warranty Enforcement Act
FOR the purpose of requiring a consumer to report certain motor
vehicles that do not conform to applicable warranties to
certain persons in a specific manner; providing for repairs
to certain motor vehicles under express warranties in
certain circumstances; providing for the replacement or
return for refund of certain motor vehicles in certain
circumstances; providing for certain affirmative defenses to
consumer claims under this Act; extending the term of
certain warranties or service periods in certain
circumstances; requiring a manufacturer or factory branch to
notify the Motor Vehicle Administration and certain
purchasers under certain circumstances; requiring certain
information to be noted on a certificate of title and on
certain written statements to certain purchasers under
certain circumstances and requiring the information to be
treated in a certain manner; providing that certain consumer
rights are not limited by this Act; requiring certain
information on certain written statements to purchasers;
requiring a consumer to resort to a certain alternative
procedure under certain circumstances; providing that
certain agreements are void; requiring that actions brought
under this Act be commenced within a certain time; allowing
a court to award attorney's fees under certain
circumstances; defining certain terms; providing that this
Act shall be construed only prospectively and may not affect
any new motor vehicle purchased or delivered prior to this
Act's effective date; exempting a certain kind of purchase
from this subtitle; and generally relating to warranties and
the enforcement of warranties for new motor vehicles.
