(Senate Bill 748)
AN ACT concerning
Sewage Sludge Management
FOR the purpose of defining certain terms; requiring the
Department of Health and Mental Hygiene to adopt rules and
regulations for sewage sludge management; requiring the
Department of Agriculture to approve certain rules and
regulations; requiring the Department of Health and Mental
Hygiene to notify county and municipal officials before the
land application of sludge and to hold a public hearing or
public information meeting under certain circumstances;
creating a State sewage sludge utilization fund;
establishing a limit on the amount of moneys to be collected
in the fund; providing for use of the fund; authorizing the
Department to assess and collect certain fees; requiring a
person to hold a sewage sludge utilization permit before
that person may utilize sludge; establishing permit
requirements; requiring the Department to send a copy of the
permit application to the affected county and municipality
and under certain circumstances to an adjacent county;
requiring the Department to maintain a permanent public
record of sewage sludge utilizations permits; allowing for
the inspection of any site where sewage sludge is utilized;
allowing the county health officer local health official to
issue a stop work order or seek injunctive relief under
certain circumstances; requiring authorizing the Department
to delegate inspection, monitoring, and enforcement power to
the county health officer local health official; providing
that the Department may suspend, revoke, or modify a sewage
sludge utilization permit under certain circumstances;
providing certain penalties and injunctive powers; allowing
certain persons to sue and have standing to contest certain
actions under this Act; and generally relating to sewage
sludge management.
BY repealing and reenacting, without amendments,

Section l-101(a) and (f) and , 9-201(a), and 9-212(c)
