(VI) THE QUANTITY OF WASTE BEING TRANSPORTED;
AND
(VII) THE NUMBER AND TYPE OF CONTAINERS; AND
(VIII) ANY OTHER INFORMATION CONSIDERED
NECESSARY BY THE DEPARTMENT.
(C) ANY GENERATOR GENERATING GREATER THAN 100 KILOGRAMS OF
CONTROLLED HAZARDOUS SUBSTANCES DURING 1 CALENDAR MONTH IS
SUBJECT TO ALL APPLICABLE RULES AND REGULATIONS ADOPTED UNDER §
7-208(E) OF THIS SUBTITLE WITH THE EXCEPTIONS THAT THE SECRETARY
CONSIDERS NECESSARY.

There is a State Hazardous Substance Control Fund.
7-219.
(A) [Except for application fees, all] ALL APPLICATION AND
permit fees, renewal fees, transporting vehicle certification
fees, CONTROLLED HAZARDOUS SUBSTANCE FEES; and ALL OTHER funds
collected by the Department under this subtitle, including any
civil or administrative penalty or any fine imposed by a court
under the provisions of this subtitle, shall be paid into the
State Hazardous Substance Control Fund.
(B) THERE IS IMPOSED A FEE, PAYABLE QUARTERLY BY EACH
GENERATOR OF CONTROLLED HAZARDOUS SUBSTANCES BEGINNING SEPTEMBER
30, 1984 AND TO BE COLLECTED BY THE DEPARTMENT, ON EACH TON OR
FRACTION OF A TON OF CONTROLLED HAZARDOUS SUBSTANCES DISPOSED OF
DURING THE 3 MONTHS IMMEDIATELY PRECEDING THE PAYMENT DATE, TO BE
DETERMINED AS FOLLOWS:
(1) $12 PER TON OF CONTROLLED HAZARDOUS SUBSTANCE
GENERATED THAT IS DISPOSED OF IN A LANDFILL; AND
(2) $8 PER TON OF CONTROLLED HAZARDOUS SUBSTANCE
GENERATED THAT IS INCINERATED, TREATED, OR DISPOSED OF, EXCLUSIVE
OF DISPOSAL IN A LANDFILL, AT A FACILITY LOCATED OFF THE SITE OF
GENERATION OF THE WASTE.
(C)(1) THE OUTSTANDING BALANCE OF THE FUND MAY NOT EXCEED
$3,000,000 AT THE END OF ANY QUARTER.
(2) IF THE FUND REACHES $3,000,000, THE COLLECTION OF
FEES SHALL END UNTIL THE OUTSTANDING BALANCE IS BELOW $3,000,000.
(D) (1) ANY 1 PERSON, CORPORATION, OR OTHER BUSINESS ENTITY
IS NOT REQUIRED TO PAY A FEE IN EXCESS OF $100,000 IN ANY 1
FISCAL YEAR.
