(A)  "RESPITE CARE" MEANS SHORT-TERM CARE OF AN INDIVIDUAL
WITH A DEVELOPMENTAL DISABILITY WHICH IS PROVIDED EITHER WITHIN
OR OUTSIDE THE INDIVIDUAL'S HOME FOR THE PURPOSE OF GIVING
TEMPORARY RELIEF TO THE INDIVIDUAL OR TO THE FAMILY.

(B)  SUBJECT TO THE APPROPRIATION PROVIDED FOR THIS PROGRAM
IN THE STATE BUDGET, RESPITE CARE FOR ONE INDIVIDUAL MAY NOT
EXCEED THE FOLLOWING LIMITS WITHIN A STATE FISCAL YEAR:

(1)  UP TO A TOTAL OF 24 HOURS OF CARE WHICH IS
PROVIDED IN PERIODS OF LESS THAN 10 HOURS IN ANY 24-HOUR PERIOD;
AND

(2)  UP TO 14 DAYS OF CARE A "DAY" BEING DEFINED FOR
PURPOSES OF THIS SECTION AS NO FEWER THAN 10 NOR MORE THAN 24
HOURS IN ANY 24-HOUR PERIOD.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

AN ACT concerning

Developmentally Disabled - Definition

FOR the purpose of expanding the definitions definition of
"developmentally disabled" "respite care" or "respite care

services" and "nonretarded developmentally disabled

individual" to include individuals with certain illnesses
and injuries under the certain services that the State
provides to certain disabled individuals.
