(2) A VIOLATION OF THIS SECTION IS A MISDEMEANOR
PUNISHABLE BY A FINE OF NOT MORE THAN $1,000.

(D) (1) THE COUNTY COMMISSIONERS OF CECIL COUNTY MAY NOT
ENTER INTO ANY CONTRACT FOR THE CONSTRUCTION OR REPAIR OF ANY
BRIDGE OR ROAD OR THE PURCHASE OR LEASE OF ANY ROAD CONSTRUCTION
EQUIPMENT OR MACHINERY EXCEPT IN ACCORDANCE WITH THE PROVISIONS
OF THIS SECTION.

(2) A CONTRACT THAT IS ENTERED INTO IN VIOLATION OF
THE PROVISIONS OF SUBSECTION (A) OF THIS SECTION IS VOID, UNLESS:

(I) IT IS DETERMINED IN A SUBSEQUENT JUDICIAL
REVIEW THAT GOOD FAITH HAS BEEN SHOWN BY ALL PARTIES; AND

(II) THERE HAS BEEN SUBSTANTIAL COMPLIANCE WITH
THE PROVISIONS OF SUBSECTION (A) OF THIS SECTION.

(3) IF A CONTRACT IS VOID UNDER THIS SECTION, A
CONTRACTOR WHO HAS ENTERED INTO THE CONTRACT IN GOOD FAITH,

WITHOUT DIRECTLY CONTRIBUTING TO A VIOLATION, AND WITHOUT

KNOWLEDGE OF ANY VIOLATION OF THIS SECTION PRIOR TO THE AWARD OF
THE CONTRACT SHALL BE COMPENSATED FOR COSTS ACTUALLY INCURRED.

Article 8 - Cecil County

1-17.

(A)  ANY EXPENDITURE MADE UNDER THIS SECTION IS SUBJECT TO
THE PROVISIONS OF SECTION 37A OF ARTICLE 25 OF THE ANNOTATED CODE
OF MARYLAND.

(B)  For the purpose of the supervision of the public roads
and bridges in Cecil County, each county commissioner shall have
control and jurisdiction over the commissioner district for which
he is elected, subject to the following regulations and
restrictions:

(1)  He shall be limited in his expenditures on the
roads and bridges in any 1 year in his commissioner district to
one-third of the amount levied for roads and bridges in the
county; said levy shall not exceed thirty-five cents on the one
hundred dollars of the entire tax levy for the county.

(2)  In case of special necessity, however, arising
from floods or other unusual damages, he may be authorized by a
unanimous vote of the board of county commissioners to expend
such other sum as it may direct.

(3)  The county commissioner in each commissioner
district shall act as supervisor of roads and bridges in his
commissioner district and shall have exclusive charge and
oversight of said roads and bridges and all repairs thereto.
