DECLINE OF THE LIVING RESOURCES OF THE CHESAPEAKE BAY, INCLUDING,
BUT NOT LIMITED TO, FINFISH, OYSTERS, AND WATERFOWL.

(4)  BEFORE AUGUST 1 OF EACH YEAR, THE DEPARTMENT
SHALL REPORT ANNUALLY TO THE LEGISLATIVE POLICY COMMITTEE OF THE
GENERAL ASSEMBLY ON THE FOLLOWING:

(I)  THE AMOUNT OF MONEY PLACED IN THE FUND
DURING THE PRIOR FISCAL YEAR AND EXPECTED TO BE RECEIVED IN THE
CURRENT FISCAL YEAR; AND

(II)  THE AMOUNT OF EXPENDITURES TO BE PROPOSED
IN THE BUDGET FOR THE FOLLOWING FISCAL YEAR AND THE PURPOSES FOR
THE EXPENDITURES.

(5)  EACH YEAR THE LEGISLATIVE POLICY COMMITTEE OF THE
GENERAL ASSEMBLY MAY RECOMMEND FOR INCLUSION IN THE STATE BUDGET
SPECIFIC USES OF THE FUND, WHICH ARE CONSISTENT WITH THE PURPOSES
STATED IN PARAGRAPH (3) OF THIS SUBSECTION. THESE RECOMMENDATIONS
ARE NOT BINDING ON THE GOVERNOR OR THE DEPARTMENT.

SECTION 2. AND BE IT FURTHER ENACTED BY THE GENERAL
ASSEMBLY OF MARYLAND, That this Act shall take effect July 1,

1984, contingent upon the taking effect of Chapter ____ of the

Acts of 1984 (H.B. 978 or S.B. 662) and if Chapter ____ does not

become effective, this Act shall be null and void without the
necessity of further action by the General Assembly.

(House Bill 1712)

AN ACT concerning

Power Plant Site Acquisition

FOR the purpose of providing that a "site" for electric power
generation includes means land necessary for a new site or
for the expansion of an existing site owned by an electric
company; defining what a "site" includes; providing that the
Secretary of Natural Resources shall not be required to
acquire a site for certain electric companies when the
company owns certain sites; eliminating the authority for an
electric utility to lease a state-owned site and eliminating
provisions relating to charges and revenue from leasing
transactions; and generally relating to power plant site
acquisition by the State.
