(1982 Replacement Volume and 1983 Supplement)

Preamble

The General Assembly hereby finds and declares that the
health, safety, and general welfare of the people of this State
are directly dependent upon the proper handling and use of
explosives in Maryland, and that 1 of the principal problems in
the explosives industry is a lack of adequate guidelines and
regulations to protect the general public, which sometimes
results in property damage, serious injury, and loss of life.

It is the purpose of this Act to examine all existing and
proposed legislation in the areas of explosives manufacture, use,
and distribution, and to advise the proper agencies of changes
which would make the handling and use of explosives safer for the
general public, users, and explosives industry employees; now,
therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 41 - Governor - Executive and Administrative

Departments

204D-1.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)  "DEPARTMENT" MEANS THE STATE DEPARTMENT OF PUBLIC
SAFETY AND CORRECTIONAL SERVICES.

(3) (I) "EXPLOSIVES" MEANS A CHEMICAL COMPOUND,
MIXTURE, OR DEVICE, THE PRIMARY PURPOSE OF WHICH IS TO FUNCTION
BY EXPLOSION.

(II) "EXPLOSIVES" INCLUDES:

1.  DYNAMITE;

2.  OTHER HIGH EXPLOSIVES;

3.  BLACK POWDER;

4.  PELLET POWDER;

5.  INITIATING EXPLOSIVES;

6.  DETONATORS;

7.  SAFETY FUSES;

8.  SQUIBS;
