BY repealing and reenacting, with amendments,

Article 81 - Revenue and Taxes

Section 49C

Annotated Code of Maryland

(1980 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 81 - Revenue and Taxes

49C.

(a)  This section applies to [the following] ALL counties
AND ALL MUNICIPAL CORPORATIONS[:].

[(1) Garrett; and

(2) Washington.]

(b)   If a business begins doing business OR AN EXISTING
BUSINESS EXPANDS TO A NEW LOCATION in the county OR MUNICIPAL
CORPORATION after the date of finality for any particular year
and does not own real property in the county OR MUNICIPAL
CORPORATION, the business, to ensure payment of the personal
property tax, shall pay to the local tax collector a fee in the
amount that the governing body of the county OR MUNICIPAL
CORPORATION determines.

(c)  The fee paid by the taxpayer is a credit toward the
county OR MUNICIPAL personal property tax of the taxpayer.

(d)  When the personal property tax of the taxpayer is
finally determined, the taxpayer, as appropriate:

(1)   Shall pay the remaining personal property tax
due; or

(2)  May claim a refund of the excessive tax paid.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
