(2) THE DEPARTMENT OF HUMAN RESOURCES SHALL ADOPT
RULES, PROCEDURES AND REIMBURSEMENT SCHEDULES NECESSARY TO
COMPENSATE FIDUCIARY INSTITUTIONS FOR COMPLIANCE WITH THIS
SECTION.
(D) (1) ON OR BEFORE JULY 1, 1985, THE DEPARTMENT OF HUMAN
RESOURCES SHALL ADOPT RULES AND REGULATIONS GOVERNING PROCEDURES
FOR REQUESTING, OBTAINING, AND EXAMINING FINANCIAL RECORDS THAT
THE DEPARTMENT DETERMINES ARE NECESSARY TO VERIFY OR CONFIRM AN
INDIVIDUAL'S ELIGIBILITY OR INELIGIBILITY FOR PUBLIC ASSISTANCE.
(2) THE SECRETARY OF HUMAN RESOURCES SHALL NOTIFY A
FIDUCIARY INSTITUTION OF THOSE OFFICERS OR EMPLOYEES OF THE
DEPARTMENT OF HUMAN RESOURCES AUTHORIZED TO REQUEST AND RECEIVE
FINANCIAL RECORDS FROM THE FIDUCIARY INSTITUTION.
(3) AN OFFICER, EMPLOYEE, OR REPRESENTATIVE OF ANY
AGENCY AUTHORIZED TO RECEIVE INFORMATION UNDER THIS SECTION MAY
NOT DISCLOSE ANY PERSONALLY IDENTIFIABLE INFORMATION OBTAINED OR
MAINTAINED UNDER THIS SECTION.
SECTION 2. AND BE IT FURTHER ENACTED, That on or before
January 1, 1986 the Department of Human Resources shall report to
the General Assmembly on the Department's activities under this
Act. The report shall include:
(1) Information on the total number of cases handled
by the Department;
(2) Information on the number of cases that the
Department reviewed under the provisions of this Act;
(3) Data on the number of fiduciary institutions
contacted for information under this Act; and
(4) A cost benefit analysis of the Department's
activities under this Act.
SECTION 3 2. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1984.
