TO PARAGRAPH (1) OF THIS SUBSECTION, SHALL BE UTILIZED AS
FOLLOWS:
(I) $24,000,000 SHALL BE UTILIZED, AS PROVIDED
FOR IN THE ANNUAL STATE BUDGET, FOR PURPOSES SPECIFIED IN TITLE
5, SUBTITLE 9 (PROGRAM OPEN SPACE) OF THE NATURAL RESOURCES
ARTICLE. FUNDS APPROPRIATED IN THE BUDGET FOR PROGRAM OPEN SPACE
SHALL REMAIN AVAILABLE UNTIL EXPENDED, AND SHALL NOT BE REVERTED
UNDER ANY OTHER PROVISION OF LAW; AND
(II) THE AMOUNT IN EXCESS OF THE $24,000,000
UTILIZED PURSUANT TO ITEM (I) OF THIS PARAGRAPH SHALL BE CREDITED
TO THE GENERAL FUND OF THE STATE.
SECTION 2. AND BE IT FURTHER ENACTED, That the changes made
to Article 81, § 278A(f) by this Act shall only be effective for
a period of six years and shall have no effect on or after July
1, 1990, and the Michie Company in preparing the 1990 cumulative
supplement to the Annotated Code and any replacement volume shall
publish Article 81, § 278A(f) as it appeared on June 30, 1984,
except that any other changes by other Acts of the General
Assembly to Article 81, § 278A(f) prior to July 1, 1990 shall
continue to have the force and effect of law, unless otherwise
provided.
SECTION 3. AND BE IT FURTHER ENACTED, That the General
Assembly, during the 1986 interim, shall conduct a study of
Program Open Space, and this study shall include an evaluation of
the program's overall objectives in land acquisition and project
development relative to its status as of December 31, 1986;
funding mechanisms related to the program's special fund and
revolving fund aspects and administrative procedures. From the
results of this study, which is due January 1, 1987, the General
Assembly shall determine if the State shall continue to utilize a
portion of the property transfer tax revenues under Section
278A(f) of Article 81 as part of the general fund.
SECTION 4. AND BE IT FURTHER ENACTED, That funds
appropriated, as provided for in the annual State budget for
purposes specified in Title 5 Subtitle 9 (Program Open Space) of
the Natural Resources Article, shall remain available until
expended, and shall not be reverted under any other provision of
law.
SECTION 2 5. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1984.
