AN ACT concerning

Prohibited Sale of Wild Birds - Exceptions

FOR the purpose of excepting the sale of birds that are permitted
to be sold as captive breed birds under federal and state
regulations from a general prohibition against the sale,
offer for sale, or offer to purchase, barter, or exchange
the plumage, skin, or body of nongame birds.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

10-401.

(c) (1) [A] EXCEPT FOR THE SALE OF CAPTIVE BREED BIRDS OF
PREY AS PERMITTED UNDER FEDERAL AND STATE PROPOGATION OR FEDERAL
AND STATE FALCONRY REGULATIONS, A person may not sell, offer for
sale, offer to purchase, barter, or exchange the plumage, skin,
or body of any nongame bird for, except], WHETHER CAUGHT WITHIN
THE STATE OR IN ANOTHER STATE, TERRITORY, OR COUNTRY.

(2) EXCEPT as otherwise provided, A PERSON MAY NOT
possess any game bird for sale whether caught within the State or
in another state, territory, or country.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.
