and improvement of parking facilities as a requirement for the
award of the [forty-eight (48)] 72 days of racing or any part
thereof. The terms and conditions with respect to parking
facilities may be based to the extent possible on master plans
developed by the licensees after consultation with community
organizations. Said [forty-eight (48)] 72 days of racing or any
part thereof may be withdrawn and revoked by the Commission and,
in their discretion, reallocated, if any licensee fails to
complete or continue an improvement program including parking
facilities prescribed by the Commission as a condition to the
awarding of the [forty-eight (48)] 72 days of racing or any part
thereof. The discretion of the Commission on the award of all
such dates shall be final, and the award of all dates shall
constitute a license and not a franchise.
(c) The Commission shall have the power to reject any
application for a license for any cause which it may deem
sufficient and the action of the Commission shall be final. No
one person, corporation or association shall be given a license
to conduct racing for more than ninety (90) days in one year, nor
shall more than an aggregate of one hundred and twenty (120) days
of racing be held in any one year on any one track within the
State of Maryland. Provided, the limitation in this subsection
shall not be applicable to or include the [48] 72 days granted to
the Commission in subsection (b) of this section to be awarded in
its discretion.

(b) Each mile thoroughbred licensee licensed under § 7 of
this article shall deduct the breakage computed to the 10 cents
and the following amounts on all races conducted by it: for
calendar year 1983 and all subsequent calendar years, 17 percent
of the regular mutuel pool, 19 percent of the multiple mutuel
pool involving two horses, and 25 percent of the multiple mutuel
pool involving three or more horses. Regular mutuel pool means a
separate wagering pool in which an interest is represented by a
single ticket evidencing a single wager on one horse. Multiple
mutuel pool means a separate wagering pool in which an interest
is represented by a single wager on two or more horses. Each
licensee shall apply the amounts deducted as follows:
(3) [4.09 percent] (I) 4.09 PERCENT OF THE
FOLLOWING AMOUNTS of the mutuel pools shall be paid to the
Maryland Racing Commission for the use of the State [as
provided by § 14 of this article.] :
1. EXCEPT FOR RACING CONDUCTED ON
SATURDAYS, ON THE AMOUNT WAGED THAT IS NOT IN EXCESS OF
$1,000,000 DAILY; AND
2. FOR RACING CONDUCTED ON SATURDAYS, ON
THE AMOUNT WAGERED THAT IS NOT IN EXCESS OF $1,500,000 DAILY.
