(A) (1) AT LEAST TWICE EACH YEAR THE REVIEW BOARD SHALL
REVIEW EACH GUARDIANSHIP THAT A PUBLIC AGENCY HOLDS.

(2) THE REVIEW BOARD MAY REVIEW A CASE BEFORE 6
MONTHS HAS ELAPSED IF THE DISABLED INDIVIDUAL FILES A PETITION
FOR EARLY REVIEW.

(B) (1) NOTWITHSTANDING THE PROVISIONS OF § 13-708(B)(7) OF
THE ESTATES AND TRUSTS ARTICLE, EACH TIME THAT THE REVIEW BOARD
REVIEWS A GUARDIANSHIP, THE REVIEW BOARD SHALL RECOMMEND THAT THE
GUARDIANSHIP BE:

(I)  CONTINUED;

(II)  MODIFIED; OR

(III)  TERMINATED.

(2) NOTWITHSTANDING THAT THE REVIEW BOARD RECOMMENDS
THAT A GUARDIANSHIP BE CONTINUED, THE COURT MAY ORDER THAT THE
GUARDIANSHIP BE MODIFIED OR TERMINATED.

(C)  THE DISABLED INDIVIDUAL SHALL:

(1)  ATTEND EACH REVIEW BOARD HEARING IF THE DISABLED
INDIVIDUAL IS ABLE TO ATTEND; AND

(2)  BE REPRESENTED AT EACH REVIEW BOARD HEARING BY:

(I)  THE LAWYER THAT THE DISABLED INDIVIDUAL
CHOOSES; OR

(II)  A LAWYER WHO IS APPOINTED BY THE COURT.

(D)  EXCEPT FOR PURPOSES OF A JUDICIAL PROCEEDING UNDER THIS
TITLE, ALL RECORDS OF THE REVIEW BOARD ARE CONFIDENTIAL.

SECTION 3. AND BE IT FURTHER ENACTED, That the provisions
of the new subtitle of this Act "Subtitle 4. Review Board" shall
take effect on October 1, 1984.

SECTION 4. AND BE IT FURTHER ENACTED, That the new
provisions of the subtitles of this Act, "Subtitle 1. Definitions
and General Provisions", "Subtitle 2. Adult Protective Services
Program", and "Subtitle 3. Emergency Provisions" shall take

effect on October 1, 1984, contingent on Chapter ___ of the Acts

of 1984 (H.B. ____) (41r 1039) not taking effect, and if Chapter

___ does become effective, the new subtitles of this Act,

"Subtitle 1. Definitions and General Provisions", "Subtitle 2.
Adult Protective Services Program", and "Subtitle 3. Emergency
Provisions", are null and void without the necessity of further
action by the General Assembly.
