Preamble

WHEREAS, The Insurance Commissioner has been charged with
the continuing general duties of licensing, examining, and
visiting nonprofit health service plans, and of assuring that
such plans are not operated for profit or fraudulently conducted,
and of enforcing all of the provisions of the Nonprofit Health
Service Plans subtitle of Article 48A; and

WHEREAS, The General Assembly of Maryland has determined
that effective enforcement of the provisions of the Nonprofit
Health Service Plans subtitle requires that the Insurance
Commissioner be specifically empowered to adopt reasonable rules
and regulations as necessary to carry out the subtitle; and

WHEREAS, The General Assembly of Maryland intends to
guarantee that the Insurance Commissioner of Maryland be
empowered to adopt rules and regulations; now, therefore,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

(a) Any corporation without capital stock heretofore or
hereafter organized for the purpose of establishing, maintaining
and operating a nonprofit health service plan whereby hospital,
medical, chiropodial, chiropractic, pharmaceutical, dental,
psychological or optometric care is provided by a hospital, or
hospitals, a physician or physicians, a chiropodist or
