SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1984.

AN ACT concerning

Vehicle Laws - Wearing of Headphones Headsets,
Earphones, and Earplugs

FOR the purpose of prohibiting a person from driving or
attempting to drive a motor vehicle on any highway or on
certain private property while the person is wearing an
earphone over or in both ears earplugs, a headset, or
earphones attached to a radio, tape player, or other audio
device; providing certain exceptions to this Act; and
relating generally to the wearing of headsets, earphones,
and earplugs.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Transportation

21-1120.

(A)  A PERSON MAY NOT DRIVE OR ATTEMPT TO DRIVE A MOTOR
VEHICLE ON ANY HIGHWAY OR ON ANY PRIVATE PROPERTY THAT IS USED BY
THE PUBLIC IN GENERAL IN THIS STATE WHILE THE PERSON IS WEARING
AN EARPHONE OVER OR IN BOTH EARS EARPLUGS, A HEADSET, OR
EARPHONES ATTACHED TO A RADIO, TAPE PLAYER, OR OTHER AUDIO
DEVICE.

(B) THE PROVISIONS OF SUBSECTION (A) OF THIS SECTION DO NOT
APPLY TO:

(1) A PERSON OPERATING AN AUTHORIZED EMERGENCY
VEHICLE UNDER EMERGENCY CONDITIONS;
