SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That title "Title 12. Incompetency and Insanity in
Criminal Cases", in its entirety, of Article - Health - General
of the Annotated Code of Maryland be repealed.

SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

TITLE 12.

INCOMPETENCY AND CRIMINAL RESPONSIBILITY IN CRIMINAL CASES

12-101. DEFINITIONS.

(A)  IN GENERAL.

IN THIS TITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

(B)  COMMITTED INDIVIDUAL.

"COMMITTED INDIVIDUAL" MEANS AN INDIVIDUAL COMMITTED TO THE
DEPARTMENT AS NOT CRIMINALLY RESPONSIBLE UNDER THE TEST FOR
CRIMINAL RESPONSIBILITY.

(C)  COURT.

"COURT" MEANS ANY COURT THAT HAS CRIMINAL JURISDICTION.

(D)  INCOMPETENT TO STAND TRIAL.

"INCOMPETENT TO STAND TRIAL" MEANS NOT ABLE:

(1) TO UNDERSTAND THE NATURE OR OBJECT OF THE
PROCEEDING; OR

(2) TO ASSIST IN ONE'S DEFENSE.
(E) JAIL.
