AN ACT concerning
Sources of Radiation - Certification
FOR the purpose of requiring the examination and certification of
certain machines which are sources of radiation by certain
individuals; providing for certain exceptions; defining
certain terms; requiring that certain individuals send a
certificate of compliance to the Department of Health and
Mental Hygiene; authorizing the Secretary of Health and
Mental Hygiene to establish certain rules and regulations;
prohibiting the use of uncertified sources of radiation; and
generally relating to the examination and certification of
certain sources of radiation.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

8-304.
(A) IN THIS SECTION, "RADIATION MACHINE" MEANS ANY DEVICE
THAT IS CAPABLE OF PRODUCING RADIATION.
(A)(B) AFTER JULY 1, 1985, 1986, EXCEPT FOR DENTAL OR
VETERINARY DIAGNOSIS OR TREATMENT, A PERSON MAY NOT USE ANY
RADIATION MACHINE THAT IS A SOURCE OF RADIATION FOR MEDICAL,
DENTAL, OR VETERINARY DIAGNOSIS OR TREATMENT THAT IS NOT
CERTIFIED AS COMPLYING WITH THIS SUBTITLE AND ALL RULES AND
REGULATIONS ADOPTED UNDER THIS SUBTITLE.
(B) A QUALIFIED INDIVIDUAL SHALL EXAMINE AND CERTIFY THE
SOURCE OF RADIATION AND SEND A CERTIFICATE OF COMPLIANCE TO THE
DEPARTMENT NOT MORE THAN 7 DAYS AFTER THE EXAMINATION.
(C) WITHIN 14 DAYS AFTER THE INSPECTION OF ANY RADIATION
MACHINE BY A QUALIFIED INDIVIDUAL, THE MACHINE USER SHALL PROVIDE
THE SECRETARY WITH A COPY OF THE INSPECTION.
