(House Bill 165)

AN ACT concerning

FOR

State Employees - Seasonal Leave Without Pay

the purpose of providing for procedures under which certain
State employees may be granted an extended leave of absence
without pay; requiring the Secretary of Personnel to
promulgate certain regulations; specifying certain
requirements and limitations for the granting of such leave;
prohibiting a State employer from requiring that a State
employee take seasonal leave without pay; defining certain
terms; and generally relating to seasonal leave for State
employees.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 64A - Merit System

37C.

(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.

(2)   "AGENCY" MEANS ANY EXECUTIVE DEPARTMENT OR AGENCY
IN THE EXECUTIVE BRANCH OF STATE GOVERNMENT, INCLUDING ALL
OFFICES THEREOF DIRECTLY RESPONSIBLE TO THE GOVERNOR.

(3)   "EMPLOYEE" MEANS ANY CLASSIFIED OR UNCLASSIFIED
EMPLOYEE WHO IS EMPLOYED BY ANY AGENCY.

(B) (1) THIS SECTION IS INTENDED TO ENHANCE STATE EMPLOYEE
MORALE AND STATE AGENCY EFFICIENCY BY PERMITTING EMPLOYEES TO
APPLY FOR AND RECEIVE EXTENDED LEAVES OF ABSENCE DURING PERIODS
OF ANTICIPATED LOW DEMAND FOR THE SERVICES OF THOSE EMPLOYEES.
