(I)(8) AN UNSTABLE REACTIVE CHEMICAL WHICH, IN THE PURE
STATE, OR AS PRODUCED OR TRANSPORTED, WILL VIGOROUSLY POLYMERIZE,
DECOMPOSE, CONDENSE, OR WILL BECOME SELF-REACTIVE UNDER
CONDITIONS OF SHOCKS, PRESSURE OR TEMPERATURE; AND

(J)(9) A WATER REACTIVE CHEMICAL THAT REACTS WITH WATER TO
RELEASE A GAS THAT IS EITHER FLAMMABLE OR PRESENTS A HEALTH
HAZARD.

32D.

(A)  A HAZARDOUS CHEMICAL INCLUDES ANY SUBSTANCE WHICH IS
INCLUDED IN THE DEFINITION OF HEALTH HAZARD ADOPTED BY THE UNITED
STATES OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION AND
PUBLISHED IN THE FEDERAL REGISTER ON NOVEMBER 25, 1983, AS
AMENDED FROM TIME TO TIME, UNLESS THE COMMISSIONER OBJECTS TO AN
AMENDMENT.

(B)  IF THE COMMISSIONER OBJECTS TO AN AMENDMENT, THE
COMMISSIONER SHALL PUBLISH AND MAKE PUBLIC THE REASONS FOR SUCH
OBJECTION AND SHALL AFFORD ALL INTERESTED PARTIES AN OPPORTUNITY
TO BE HEARD.

(C)  AT THE CONCLUSION OF A HEARING, THE COMMISSIONER SHALL
PUBLISH AND MAKE PUBLIC A DECISION, WHICH SHALL BE FINAL.

32E.

(A)  AN EMPLOYER SHALL COMPILE AND MAINTAIN A CHEMICAL
INFORMATION LIST WHICH SHALL CONTAIN THE FOLLOWING INFORMATION
FOR EACH HAZARDOUS CHEMICAL MANUFACTURED, PROCESSED, FORMULATED,
PACKAGED, REPACKAGED, HANDLED, REACTED, TRANSFERRED, OR STORED IN
A PLACE OF EMPLOYMENT WORKPLACE:

(1)  THE COMMON NAME;

(2)  THE CHEMICAL NAME; AND

(3)  IDENTIFICATION OF THE WORK AREA IN WHICH THE
HAZARDOUS CHEMICAL IS FOUND.

(B)  CHEMICAL INFORMATION LISTS SHALL BE:

(1)  ARRANGED IN ALPHABETICAL ORDER ACCORDING TO
COMMON NAME;

(2)  REVISED AND REALPHABETIZED BIENNIALLY; AND

(3)  MAINTAINED FOR AT LEAST 40 YEARS.

(C)  A HAZARDOUS CHEMICAL NOT ALREADY ON THE CHEMICAL
INFORMATION LIST SHALL BE ADDED TO THE CHEMICAL INFORMATION LIST
WITHIN 30 DAYS OF ITS INTRODUCTION INTO THE PLACE OF EMPLOYMENT
WORKPLACE; HOWEVER, IT NEED NOT BE PLACED ON THE LIST IN
ALPHABETICAL ORDER UNTIL THE NEXT BIENNIAL REVISION OF THE
CHEMICAL LIST.
