Crimes and Punishments - Destructive Explosive Devices

FOR the purpose of prohibiting a person or the person's aiders or
abettors from manufacturing, possessing, transporting or
placing a device constructed to represent certain devices
with a certain intent; prohibiting the manufacture,
assembly, possession, transportation, or placement of
certain explosive devices with a certain intent; providing
penalties; defining certain terms; and generally relating to
simulated and other destructive explosive devices.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 27 - Crimes and Punishments

139B.

(A)  A PERSON MAY NOT MANUFACTURE, ASSEMBLE, POSSESS,
TRANSPORT, OR PLACE IN THIS STATE ANY DESTRUCTIVE EXPLOSIVE
DEVICE WITH THE INTENT TO TERRORIZE, FRIGHTEN, INTIMIDATE,
THREATEN, OR HARASS, MOLEST, OR ANNOY.

(B)  THE TERM "DESTRUCTIVE EXPLOSIVES EXPLOSIVE DEVICE"
SHALL INCLUDE ANY EXPLOSIVE, AS DEFINED BY ARTICLE 38A, § 26A OF
THE CODE, INCENDIARY OR POISONOUS GAS INCORPORATED INTO A BOMB,
GRENADE, ROCKET HAVING A PROPELLANT CHARGE, MISSLE MISSILE HAVING
AN EXPLOSIVE OR INCENDIARY CHARGE, MINE, OR OTHER SIMILAR DEVICE.

(C)  A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A
FELONY AND, UPON CONVICTION, IS SUBJECT TO IMPRISONMENT FOR 20
YEARS OR A FINE OF $10,000 OR BOTH.

151B.

(A)  A PERSON,OR THE PERSON'S AIDERS OR ABETTORS; MAY NOT
MANUFACTURE, POSSESS, TRANSPORT, OR PLACE A DEVICE THAT IS
CONSTRUCTED TO REPRESENT A BOMB, EXPLOSIVE, INCENDIARY, OR
DESTRUCTIVE EXPLOSIVE DEVICE WITH THE INTENT TO TERRORIZE,
FRIGHTEN, INTIMIDATE, THREATEN, OR HARASS, MOLEST , OR ANNOY.

(B)  A PERSON WHO VIOLATES THIS SECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION, IS SUBJECT TO IMPRISONMENT FOR 1
YEAR OR A FINE OR $1,000 OR BOTH.
