involving taxicab permit holders and taxicab drivers under
the Commission's jurisdiction; authorizing the
recommendation of certain penalties for imposition by the
Commission; changing the title of this position to Taxicab
Hearing Officer; making stylistic changes; and generally
relating to the regulation of taxicabs by the Public Service
Commission.

BY repealing and reenacting, with amendments,

Article 78 - Public Service Commission Law

Section 50H and 50K

Annotated Code of Maryland

(1980 Replacement Volume and 1983 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 78 - Public Service Commission Law

50H.

Where it shall appear after an administrative review that by
reason of the physical or mental condition of the applicant or by
reason of a prior criminal record that the public convenience and
necessity requires that an application for a license be denied,
the applicant shall have the right to request a hearing by the
Commission and the Commission may in its discretion have such
hearing conducted by the taxicab [license] hearing officer. If
after hearing, the Public Service Commission shall refuse to
issue a license, the applicant shall have the right to appeal
from such refusal in the same manner as appeals may now be taken
from other actions of the Public Service Commission.

50K.

(a)  There shall be created a position of taxicab [license]
hearing officer. [He] THE TAXICAB HEARING OFFICER shall be
appointed by the Commission and serve at the pleasure of the
Commission. [He] THE TAXICAB HEARING OFFICER shall receive an
annual salary as provided in the annual State budget.

(b)  The taxicab [license] hearing officer shall be vested
with the power to hold hearings involving [violations by taxicab
drivers of Baltimore City taxicabs.]:

(1)  VIOLATIONS OF THIS ARTICLE OR THE COMMISSION'S
RULES AND REGULATIONS BY TAXICAB DRIVERS OF BALTIMORE CITY
TAXICABS; AND

(2)  VIOLATIONS OF THIS ARTICLE OR THE COMMISSION'S
RULES AND REGULATIONS, EXCEPT THOSE RELATING TO RATES, BY HOLDERS
OF TAXICAB PERMITS IN BALTIMORE CITY, BALTIMORE COUNTY, THE CITY
OF HAGERSTOWN, AND THE CITY OF CUMBERLAND, AND ANY INCORPORATED
CITY OR TOWN HAVING A POPULATION OF MORE THAN 50,000 PERSONS.
