had in the same county or city as the subsequent proceeding under
[this subtitle] TITLE 5, SUBTITLE 10 OF THE FAMILY LAW ARTICLE,
the court shall, in discharging [such] THE person from
commitment, probation or any other order or condition imposed in
[said] THAT proceeding, sit and act, pro tem, as a court of
criminal jurisdiction in [said] THAT county or city. Where
[said]. THE prior proceedings were had in a different county or
city, the court having jurisdiction therein shall, upon motion of
any person in interest, pass [such orders] ANY ORDER and take
[such] ANY further steps in [said] THE prior proceedings as may
be proper or necessary to transfer full jurisdiction [in the
premises] OVER THE PROCEEDING to the court of the county [or
city] wherein the proceedings under [this subtitle] TITLE 5,
SUBTITLE 10 OF THE FAMILY LAW ARTICLE are pending [as aforesaid].
Nothing contained herein shall be construed as authorizing the
court to review, set aside, revoke, or otherwise impair the
judgment of conviction in [said] THE prior proceedings.
SECTION 4. AND BE IT FURTHER ENACTED, That Section(s) of
the Annotated Code of Maryland read(s) as follows:
Article 27 - Crimes and Punishments
CHILD ABUSE
35A.
(A) (1) IN THIS SECTION THE FOLLOWING WORDS HAVE THE
MEANINGS INDICATED.
(2) "ABUSE" MEANS:
(I) THE SUSTAINING OF PHYSICAL INJURY BY A
CHILD AS A RESULT OF CRUEL OR INHUMANE TREATMENT OR AS A RESULT
OF A MALICIOUS ACT BY ANY PARENT OR OTHER PERSON WHO HAS
PERMANENT OR TEMPORARY CARE OR CUSTODY OR RESPONSIBILITY FOR
SUPERVISION OF A CHILD UNDER CIRCUMSTANCES THAT INDICATE THAT THE
CHILD'S HEALTH OR WELFARE IS HARMED OR THREATENED THEREBY; OR
(II) SEXUAL ABUSE OF A CHILD, WHETHER PHYSICAL
INJURIES ARE SUSTAINED OR NOT.
(3) "CHILD" MEANS ANY INDIVIDUAL UNDER THE AGE OF 18
YEARS.
(4) (I) "SEXUAL ABUSE" MEANS ANY ACT THAT INVOLVES
SEXUAL MOLESTATION OR EXPLOITATION OF A CHILD BY A PARENT OR
OTHER PERSON WHO HAS PERMANENT OR TEMPORARY CARE OR CUSTODY OR
RESPONSIBILITY FOR SUPERVISION OF A CHILD.
(II) "SEXUAL ABUSE" INCLUDES, BUT IS NOT
LIMITED TO:
A. INCEST, RAPE, OR SEXUAL OFFENSE IN ANY
DEGREE;
