relationship between this section and Article 27, §
700E of the Code is unclear. Article 27, § 700E
establishes an "extended work release program" for
individuals committed to the jurisdiction of the
Division of Correction for nonsupport or desertion.
The program permits the Commissioner of Correction to
establish a plan with an inmate that will provide for
"disposition of earnings towards maintenance and
support of family".

10-208. VENUE.

(A)  NONSUPPORT OF SPOUSE.

AN INDIVIDUAL WHO IS CHARGED WITH NONSUPPORT OF THE
INDIVIDUAL'S SPOUSE MAY BE PROSECUTED IN THE JURISDICTION WHERE
THE INDIVIDUAL OR THE SPOUSE RESIDES.

(B)  NONSUPPORT OR DESERTION OF MINOR CHILD.

AN INDIVIDUAL WHO IS CHARGED WITH NONSUPPORT OR DESERTION OF
THE INDIVIDUAL'S MINOR CHILD MAY BE PROSECUTED IN THE
JURISDICTION WHERE THE INDIVIDUAL OR THE INDIVIDUAL'S MINOR CHILD
RESIDES.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second sentence of
former Article 27, § 88(a) and the first sentence of
(b)(2).

10-209. EFFECT OF CIVIL ACTION.

THE COMMENCEMENT OF A CIVIL ACTION FOR CHILD SUPPORT DOES
NOT AFFECT THE JURISDICTION OF THE COURT IN A CRIMINAL ACTION FOR
NONSUPPORT OR DESERTION.

former Article 27, § 88(b)(2).
