2138                                         LAWS OF MARYLAND                                 Ch. 296

(I)  IF THE INDIVIDUAL IS SUMMONED TO APPEAR BY
THE COURT WITHIN THE 3-YEAR PROBATIONARY PERIOD, THE INDIVIDUAL
SHALL APPEAR; AND

(II)  THE INDIVIDUAL SHALL PAY SUPPORT AS
ORDERED BY THE COURT.

(B)  REVOCATION.

DURING THE 3-YEAR PROBATIONARY PERIOD, IF AN INDIVIDUAL
FAILS TO PAY SUPPORT UNDER THE COURT'S ORDER, THE COURT MAY
PROCEED TO TRY OR SENTENCE THE INDIVIDUAL.

(C)  DISPOSITION OF FORFEITED RECOGNIZANCE.

THE COURT MAY ORDER THAT A FORFEITED RECOGNIZANCE BE PAID
WHOLLY OR PARTLY AS PROVIDED IN § 10-202(C) OR § 10-204(C) OF
THIS SUBTITLE, AS APPROPRIATE.

REVISOR'S NOTE: This section is new language that combines,
without substantive change, the sixth, seventh, and
eighth sentences and the last clause of the third
sentence of former Article 27, § 88(a) and the eighth,
ninth, and tenth sentences and the last clause of the
fifth sentence of (b)(3).

In subsection (a) of this section, the former
references to "then the recognizance shall be void,
otherwise of full force and effect" are deleted as
unnecessary.

In subsection (a)(1) of this section, the former
references to "with or without sureties" are deleted
as unnecessary.

In subsection (b) of this section, the former
references to "by information and due proof under
oath" are deleted as unnecessary in light of
requirements for revocation of probation in general.

In subsection (c) of this section, the cross-reference
to §§ 10-202(c) and 10-204(c) of this subtitle is
substituted for the former references to "the spouse"
and "the person or institution having custody of the
miner child or children or to the bureau of support
enforcement", for conciseness and consistency.

10-206. LIEN ON EARNINGS.

(A) ESTABLISHMENT OF LIEN.

AN ORDER TO PAY SUPPORT UNDER THIS SUBTITLE IS A LIEN ON THE
EARNINGS OF THE ACCUSED INDIVIDUAL.
