REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 16, §
66H(d).

In subsection (a)(1) of this section, "in the
premises", which formerly modified "jurisdiction", is
deleted as unnecessary.

5-1040. SEALING OF PAPERS.

(A)  ON COMPLETION OF PROCEEDING.

ON COMPLETION OF A PATERNITY PROCEEDING, THE COURT MAY ORDER
THE CLERK OF COURT:

(1)  TO SEAL ALL PAPERS IN THE CASE; AND

(2)  NOT TO OPEN ANY PAPERS IN THE CASE, EXCEPT ON
ORDER OF THE COURT.

(B)  FURTHER PROCEEDINGS.

IN ANY FURTHER PROCEEDING UNDER § 5-1038 OF THIS SUBTITLE ON
SUPPORT PAYMENTS OR CUSTODY, THE PAPERS IN THE CASE, ONCE ORDERED
SEALED, SHALL REMAIN SEALED UNLESS THE COURT ORDERS OTHERWISE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 16, §
66H(h).

In subsection (b) of this section, "once ordered
sealed", which modifies "papers in the case", is new
language added for clarity.

Also in subsection (b) of this section, the word
"orders" is substituted for the former word "direct",
for clarity and consistency.

5-1041. ENFORCEMENT OF ORDER.

(A)   IN GENERAL.

A COURT ORDER UNDER THIS SUBTITLE IS ENFORCEABLE IN THE SAME
MANNER AND TO THE SAME EXTENT AS ANY OTHER ORDER OF AN EQUITY
COURT IN THIS STATE.

(B)  SUPPORT ORDERS.

IF AN INDIVIDUAL FAILS TO MAKE A SUPPORT PAYMENT ORDERED
UNDER THIS SUBTITLE, THE INDIVIDUAL SHALL BE SERVED WITH AN ORDER
THAT DIRECTS THE INDIVIDUAL TO SHOW CAUSE WHY THAT INDIVIDUAL
SHOULD NOT BE HELD IN CONTEMPT.
