5-705. INVESTIGATION.

(A)  INITIATION OF INVESTIGATION.

PROMPTLY AFTER RECEIVING A REPORT OF A SUSPECTED NEGLECTED
CHILD, THE LOCAL DEPARTMENT SHALL MAKE A THOROUGH INVESTIGATION
TO PROTECT THE HEALTH, SAFETY, AND WELFARE OF THE CHILD OR
CHILDREN.

(B)  FINDING OF NEGLECT.

IF THERE IS A FINDING OF NEGLECT, THE LOCAL DEPARTMENT SHALL
DETERMINE:

(1)  THE NATURE, EXTENT, AND CAUSE OF THE NEGLECT;

(2)  THE IDENTITY OF THE INDIVIDUAL WHO IS RESPONSIBLE
FOR THE NEGLECT;

(3)  THE NAME, AGE, AND CONDITION OF EVERY OTHER CHILD
IN THE HOUSEHOLD; AND

(4)  ANY OTHER PERTINENT INFORMATION.

(C)  WRITTEN REPORT OF FINDINGS.

WITHIN 10 BUSINESS DAYS AFTER THE COMPLETION OF AN
INVESTIGATION UNDER THIS SUBTITLE, THE LOCAL DEPARTMENT SHALL
MAKE A WRITTEN REPORT OF ITS FINDINGS. THE REPORT SHALL:

(1)  STATE WHETHER NEGLECT IS:

(I)  CONFIRMED;

(II)  RULED OUT; OR

(III)  UNCERTAIN; AND

(2)  IF THERE IS A FINDING OF NEGLECT, INCLUDE A
TREATMENT PLAN.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 72A, §
8(a), (b), and (c).

In subsection (a) of this section, the word
"suspected" is new language added for clarity.

Subsection (c)(1) of this section is revised using
language that conforms to practice.
