THE DEPARTMENT SHALL MAKE THE PAMPHLET AVAILABLE TO DAY CARE
PROVIDERS FOR DISTRIBUTION TO PARENTS.

REVISOR'S NOTE: This section formerly appeared as Article
88A, § 32F.

In subsection (c) of this section, language is added
to clarify that the duty to make pamphlets available
is imposed on the Department.

The only other changes are in style.

Defined terms: "Day care provider" § 5-501
"Department" § 5-101 "Family day care" § 5-501
"Local department" § 5-501

5-556. PENALTY.

A PERSON WHO VIOLATES ANY PROVISION OF THIS PART V OF THIS
SUBTITLE OR ANY RULE OR REGULATION ADOPTED UNDER THIS PART V OF
THIS SUBTITLE IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS
SUBJECT TO A FINE NOT EXCEEDING $500.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 88A, §
32G(b).

The phrase "is guilty of a misdemeanor" is new
language added for clarity.

5-557. CONSTRUCTION.

THIS PART V OF THIS SUBTITLE MAY NOT BE CONSTRUED TO IMPAIR
OR LIMIT THE AUTHORITY GRANTED TO THE DEPARTMENT OF HUMAN
RESOURCES, THE DEPARTMENT OF EDUCATION, OR THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE UNDER ANY OTHER PROVISION OF THE CODE
UNLESS THAT PROVISION NECESSARILY IS INCONSISTENT WITH THIS PART
V OF THIS SUBTITLE.

REVISOR'S NOTE: This section formerly appeared as Article
88A, § 32H.

The only changes are in style.

GENERAL REVISOR'S NOTE:

Former Article 88A, § 30, which provided for prosecution by
the State's Attorney of all violations of the licensing
provisions, is deleted as unnecessary.

Throughout this subtitle, with 2 exceptions, the former
references to a "natural parent" are changed to references to a
"parent", because the Commission to Revise the Annotated Code
interpreted the former references to have been intended to
distinguish natural or adoptive parents from foster parents,
