5-411. ADMINISTRATIVE AND JUDICIAL REVIEW.

AN INDIVIDUAL WHO IS AGGRIEVED BY A FINAL DECISION OF THE
DIRECTOR OF A LOCAL DEPARTMENT THAT DENIES ELIGIBILITY OR REDUCES
OR TERMINATES A SUBSIDY IN A CONTESTED CASE MAY:

(1)  APPEAL THAT DECISION TO THE ADMINISTRATIVE
APPELLATE AUTHORITY DESIGNATED BY RULE OR REGULATION; AND

(2)  THEN TAKE ANY FURTHER APPEAL ALLOWED BY THE
ADMINISTRATIVE PROCEDURE ACT.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 16, §
88F.

In the introductory language of this section, the
references to a "final decision" and a "contested
case" are added to conform to the Administrative
Procedure Act, which provides a right of judicial
review of an agency decision in a "contested case".

Also in the introductory language of this section, the
phrase "denies eligibility or reduces or terminates a
subsidy" is substituted for the former phrase "denying
eligibility or denying a subsidy", for clarity and to
conform to practice.

Item (l) of this section is new language added for
clarity and to conform to actual practice.

5-412. DUTIES OF DIRECTOR OF ADMINISTRATION.

THE DIRECTOR OF THE SOCIAL SERVICES ADMINISTRATION OF THE
DEPARTMENT SHALL ADOPT RULES AND REGULATIONS TO CARRY OUT THE
PROVISIONS OF THIS SUBTITLE.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 16, §
88G.

The reference to the "Director" is new language added
for clarity.
