SUBTITLE 4. ADOPTION SUBSIDY ACT.

PART I. DEFINITIONS; GENERAL PROVISIONS.

5-401. DEFINITIONS.

(A)   IN GENERAL.

IN THIS SUBTITLE THE FOLLOWING WORDS HAVE THE MEANINGS
INDICATED.

REVISOR'S NOTE: This subsection is new language added as
the standard introductory language to a definition
section.

(B)  ELIGIBLE CHILD.

"ELIGIBLE CHILD" MEANS A MINOR CHILD AS TO WHOM:

(1)  GUARDIANSHIP WITH THE RIGHT TO CONSENT TO
ADOPTION HAS BEEN AWARDED TO A CHILD PLACEMENT AGENCY UNDER
SUBTITLE 3 OF THIS TITLE; AND

(2)  A DETERMINATION HAS BEEN MADE BY A LOCAL
DEPARTMENT UNDER § 5-403 OF THIS SUBTITLE THAT A SUBSIDY IS
NECESSARY TO ASSURE THE CHILD'S ADOPTION BECAUSE OF THE CHILD'S
SPECIAL CIRCUMSTANCES.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from the first clause of
former Article 16, § 88A.

Item (1) of this subsection is substituted for the
former phrase "legally free for adoption", to conform
to the interpretation of that phrase reflected in
COMAR 07.02.12.06. This substitution is called to the
attention of the General Assembly.

(C)  LOCAL DEPARTMENT.

"LOCAL DEPARTMENT" MEANS A LOCAL DEPARTMENT OF SOCIAL
SERVICES OF A COUNTY.
