5-324. TIME FOR ENTERING FINAL DECREE.

THE COURT MAY NOT ENTER A FINAL ADOPTION DECREE UNTIL AT
LEAST 15 DAYS AFTER THE BIRTH OF THE INDIVIDUAL TO BE ADOPTED.

REVISOR'S NOTE: This section is new language derived
without substantive change from the third clause of
Article 16, § 74(b).

5-325. JURISDICTIONAL OR PROCEDURAL DEFECT IN FINAL ADOPTION
DECREE.

A COURT MAY NOT RECEIVE A PETITION TO INVALIDATE A FINAL
DECREE OF ADOPTION BECAUSE OF A PROCEDURAL OR JURISDICTIONAL
DEFECT UNLESS THE PETITION IS FILED WITHIN 1 YEAR AFTER THE ENTRY
OF THE FINAL DECREE OF ADOPTION.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 16, §
79.

The former phrase "or by any court of this State" is
deleted as unnecessary.

The word "regularly", which formerly modified "filed",
is deleted as unnecessary.

5-326. FULL FAITH AND CREDIT.

A FINAL DECREE OF ADOPTION GRANTED IN ANOTHER JURISDICTION:

(1)  SHALL BE GIVEN FULL FAITH AND CREDIT IN THIS
STATE; AND

(2)  HAS THE SAME LEGAL EFFECT AS A FINAL DECREE OF
ADOPTION GRANTED IN THIS STATE.

REVISOR'S NOTE: This section is new language derived
without substantive change from the second and third
sentences of former Article 16, § 80.

"When the question is properly presented to a court in
this State and if the party against whom judgment
would be rendered is subject to the jurisdictional
processes of the courts of this State", which formerly
appeared in the third sentence of Article 16, § 80, is
deleted as unnecessary because these conditions apply
in any event.
