Ch. 296

The Commission to Revise the Annotated Code notes, for
consideration by the General Assembly, that the General Assembly
may wish to repeal the Married Women's Property Acts, and in
their place, enact a single statute that reads: "A married woman
has the same rights and liabilities that she would, have if she
were unmarried."

The Commission to Revise the Annotated Code also calls the
attention of the General Assembly to the substitution throughout
this subtitle and Subtitle 3 of this title of the phrase "before
or during marriage" for the former phrase "before or after
marriage", for clarity. In keeping with the spirit of the former
law, in Subtitle 3 of this title, the clause "after it ends" is
substituted for the former clause "after such coverture has
terminated" .

4-202. RIGHTS OF SURVIVING SPOUSE.

A SURVIVING SPOUSE WHO BRINGS A PERSONAL ACTION TO RECOVER
IN RIGHT OF THE DECEASED SPOUSE SHALL ALLEGE:

(1)   SPECIFICALLY HOW THE DEBT OR RIGHT ACCRUED TO THE
DECEASED SPOUSE; AND

(2)   STATING FURTHER THAT, BY MARRIAGE, THE DEBT OR
RIGHT DEVOLVED ON THE SURVIVING SPOUSE.

REVISOR'S NOTE: This section formerly appeared as Article
45, § 19.

In the introductory language of this section, the term
"surviving spouse" is substituted for the former term
"person", for clarity.

Also in the introductory language of this section, the
term "deceased spouse" is substituted for the former
phrase "his or her spouse after the spouse's death",
for brevity.

Also in the introductory language of this section, the
phrase "shall allege" is substituted for the former
phrase "may declare specifically setting forth in the
usual manner", for brevity.

In item (1) of this section, the word "deceased",
which modifies "spouse", is new language added for
clarity.

In item (2) of this section, the phrase "surviving
spouse" is substituted for the former phrase "him or
her", for clarity.

The only other changes are in style.
