(1)  AN AUTHORIZED OFFICIAL MAY NOT GIVE OR OFFER TO
GIVE ANY REWARD TO ANY PERSON AS AN INDUCEMENT TO DIRECT TO THE
AUTHORIZED OFFICIAL ANY INDIVIDUAL WHO IS CONTEMPLATING MARRIAGE.

(2)  A PERSON MAY NOT ERECT OR MAINTAIN ANY
INFORMATION BOOTH OR ADVERTISEMENT THAT IS INTENDED TO HELP
SOLICIT THE PERFORMANCE OF ANY MARRIAGE CEREMONY.

(B) PENALTIES.

(1)  AN AUTHORIZED OFFICIAL WHO VIOLATES THE
PROVISIONS OF SUBSECTION (A)(1) OF THIS SECTION IS GUILTY OF A
MISDEMEANOR AND ON CONVICTION IS SUBJECT TO A FINE NOT EXCEEDING
$50 FOR EACH OFFENSE.

(2)  A PERSON WHO VIOLATES THE PROVISIONS OF
SUBSECTION (A)(2) OF THIS SECTION IS GUILTY OF A MISDEMEANOR AND
ON CONVICTION IS SUBJECT:

(I)  FOR THE FIRST OFFENSE, TO A FINE NOT
EXCEEDING $100; AND

(II)  FOR EACH SUBSEQUENT OFFENSE, TO A FINE NOT
EXCEEDING $500 OR IMPRISONMENT NOT EXCEEDING 1 YEAR OR BOTH.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Article 27, §§
396 and 397.

In subsection (a)(1) of this section, "either directly
or indirectly", which formerly modified "give", is
deleted as unnecessary.

Also in subsection (a)(1) of this section, the former
terms "money" and "present" are deleted as included in
"reward".

Also in subsection (a)(1) of this section, the former
phrase "hotel or railroad porter" is deleted as
included in "person".

Also in subsection (a)(1) of this section, the former
terms "bring" and "take" are deleted as included in
"direct".

In subsection (a)(2) of this section, the former terms
"firm" and "corporation" are deleted as included in
"person".

Also in subsection (a)(2) of this section, the former
phrase "billboards or other structures, signs, posters
or display advertising of any kind whatsoever, either
as separate structures or otherwise ... or any other
structures, any one or more of which", is deleted as
included in the phrase "information booth or
advertisement".
