(E) (D) NOTICE OF ANY AWARD UNDER THIS SECTION SHALL BE
PUBLISHED IN THE MARYLAND REGISTER.

(b) (1) Before award, the State may not disclose the
contents of a proposal OR AN EXPRESSION OF INTEREST UNDER § 3-207
(NONCOMPETING SOURCE SERVICES PROCUREMENT) to any person other
than a State employee or other person responsible for evaluating
or reviewing the proposal OR EXPRESSION OF INTEREST.
(2) After award, the contents of the successful
proposal OR ACCEPTED TERMS AND CONDITIONS RESULTING FROM AN
EXPRESSION OF INTEREST are open to public inspection as provided
in the public information act. The contents of an unsuccessful
proposal OR WRITTEN EXPRESSION OF INTEREST UNDER § 3-207 are
available for public inspection as provided in the public
information act only with the consent of the offeror OR THE
SUBMITTING SERVICE PROVIDER.

(d) Within 90 days after the close of each fiscal year, the
Board shell make a report, subject to Article 40, § 51 of the
Code, to the General Assembly of each expedited procurement
approved under § 3-205(b) AND OF EACH PROCUREMENT AGENCY OR CLASS
OF PROCUREMENTS FOR WHICH THE BOARD HAS APPROVED THE USE OF THE
NONCOMPETING SOURCE SERVICES PROCUREMENT METHOD DESCRIBED IN
NONCOMPETITIVE NEGOTIATED PROCUREMENT APPROVED UNDER § 3-207 of
this article.
(a) Within 90 days following the close of the fiscal year,
each department shall make an annual report to the Governor and,
subject to Article 40, § 51 of the Code, to the General Assembly
of contracts made under § 3-205(A) AND (B) during that preceding
fiscal year. The report shall:
(1) Name each contractor;
(2) State the amount and type of each contract;
(3) Describe the supplies, services, and construction
procured; and
(4) Describe the basis for noncompetitive award.
(b) Within 90 days following the close of the fiscal year,
each department shall make an annual report to the Governor,
SUBJECT TO § 2-1312 OF THE STATE GOVERNMENT ARTICLE, and TO the
General Assembly of contracts for services which exceed $100,000
during the preceding fiscal year. The report shall:
