Preamble
In adopting this Act, it is the purpose of the General
Assembly to carry out the proposals on pension benefits that were
approved by the Joint Legislative and Executive Committee on
Pensions and that are described in the Committee's report to the
1984 General Assembly; now, therefore,
SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 64A - Merit System
48B.
(A) AS USED IN THIS SECTION, "STATE SERVICE" MEANS SERVICE
WITH THE STATE AS AN EMPLOYEE OR TEACHER AS DEFINED UNDER
ARTICLE 73B, §§ 1(3), 81(3), 111(4), AND 140(4).
(B) IF AN INDIVIDUAL WHO HAS RETIRED FROM JULY 1, 1984 WITH
A STATE RETIREMENT ALLOWANCE AND HAD AT LEAST 5 YEARS OF STATE
SERVICE, THE RETIRED INDIVIDUAL MAY PARTICIPATE AS PROVIDED BY
THIS SECTION IN THE STATE EMPLOYEES HEALTH INSURANCE PROGRAM.
(C)(1) EXCEPT AS PROVIDED BY PARAGRAPH (2) OF THIS
SUBSECTION (C), A RETIRED INDIVIDUAL IS ELIGIBLE TO RECEIVE THE
SUBSIDY PROVIDED BY THE STATE FOR THE COST OF THE PROGRAM ON THE
FOLLOWING BASIS:
(I) IF A RETIRED INDIVIDUAL HAD AT LEAST 5
YEARS OF STATE SERVICE, THE RETIRED INDIVIDUAL SHALL RECEIVE
FIVE SIXTEENTHS OF THE SUBSIDY PROVIDED TO A STATE EMPLOYEE;
(II) IN ADDITION, IF A RETIRED INDIVIDUAL HAD
MORE THAN 5 BUT LESS THAN 16 YEARS OF STATE SERVICE, THE RETIRED
