28-11. Bids; contracts.
(A) Except as permitted by this Section, [the Commission
shall,] before proceeding with construction of any project or
projects in a subdistrict, THE COMMISSION SHALL solicit, in the
name of the District, competitive sealed bids for such
construction, as a whole[,] or in parts, as in its judgment may
seem advisable.
(B) Notice of the solicitation of [such] bids shall be
published IN AT LEAST 1 GENERAL CIRCULATION NEWSPAPER PUBLISHED
IN THE COUNTY at least once in each of [two] 2 successive weeks
next preceding the date [upon] ON which [said] THE bids will be
received [in at least one newspaper published and of general
circulation in the County] and in [such] WHATEVER other
newspapers or technical journals [as] THAT the Commission [shall
deem proper] DIRECTS. [Said] THE notice shall describe briefly:
(1) [the] THE project, [or] projects, or parts
[thereof,] OF PROJECTS for which single or separate bids will be
entertained[,];
(2) [the] THE time and place for receipt of bids[,];
(3) [the] THE place where plans, specifications, bid
and contract forms may be examined or obtained[,]; and [such
other]
(4) THE information [as] THAT the Commission [may
deem] CONSIDERS necessary or desirable to place all prospective
bidders on an equal footing.
(C) In [any such] bid documents, the Commission shall
clearly reserve the right to reject any and all bids; [but no] A
contract [shall] MAY NOT be awarded pursuant (thereto] TO THE
BIDS, except to the lowest responsible bidder[,] whose bid is
legally acceptable. If the Commission rejects all such bids, it
may re-advertise for new bids in the manner [herein]
prescribed[,] IN THIS SECTION for all or any part of the work and
may elect to cause any part not so re-advertised[,] to be
constructed as an improvement[, as hereinafter permitted]. All
contracts awarded by the Commission shall be protected by [such]
bonds, penalties and conditions [as] REQUIRED BY the Commission
[may require] in the bid documents[, all of which shall be
enforceable by the]. THE District MAY ENFORCE BONDS, PENALTIES,
AND CONDITIONS in any court of competent jurisdiction. [In
addition, the Commission may, without] WITHOUT advertising for or
receiving bids, THE COMMISSION [expend] MAY not EXPEND more than
[ten thousand dollars] $10,000 for any [one] 1 improvement. (1957
