(ii) Each other person entitled to notice under
this title.
[(d) (1) Within 10 days of the order of the Commissioner
under subsection (c) of this section, any aggrieved party may
appeal the order to the Commission.
(2) On appeal, the Commission may, but need not, hold
a hearing. The determination of the Commission as to the
appropriate forum is final.]
13-406.
(a) If, under § 13-405 of this subtitle, the proceeding is
set for a hearing before the Commissioner, the Commissioner shall
hold the hearing in accordance with the Administrative Procedure
Act as soon as practicable within 30 days of the order of the
Commissioner under § 13-405 (c) of this subtitle [or, if that
order is appealed, the determination of the Commission].
13-407.
(a) If, under § 13-405 of this subtitle, the proceeding is
to be referred to the circuit court for declaratory relief, then,
within 30 days of the order of the Commissioner under § 13-405
(c) of this subtitle [or, if that order is appealed, the
determination of the Commission], the applicant shall file a bill
of complaint in equity in the circuit court for the county in
which the largest portion of the land described in the warrant is
located. The bill of complaint shall seek declaratory relief
under Title 3, Subtitle 4 of the Courts Article, the Maryland
Uniform Declaratory Judgments Act.
SECTION 6. AND BE IT FURTHER ENACTED, That Section(s)
10-604 through 10-608, 10-631 through 10-633, 10-636 through
10-641, 10-701, 10-702, 13-501, and 13-502 and the subtitle
"Subtitle 5. Maryland Manual" of Article - State Government of
the Annotated Code of Maryland (as enacted by Chapter ____ (S.B.
50) of the Acts of the General Assembly of 1984) be repealed.
SECTION 7. AND BE IT FURTHER ENACTED, That Section(s) 5-119
through 5-124 of Article 24 - Political Subdivisions
Miscellaneous Provisions of the Annotated Code of Maryland (as
enacted by Chapter ____ (S.B. 50) of the Acts of the General
Assembly of 1984) be repealed.
SECTION 8. AND BE IT FURTHER ENACTED, That Section(s) of
the Annotated Code of Maryland be transferred, without amendment,
as follows:
