(2) THE UNITED STATES MAY CONDEMN MORE THAN 10 ACRES
ON WHICH TO BUILD AN ARSENAL, COASTAL DEFENSE, FORT, OR MAGAZINE,
INCLUDING THE BARRACKS FOR STAFF.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 96, § 16,
the second sentence of § 5, and the second clause of §
20.

In subsection (b)(2) of this section, the reference to
land "on which to build ... the barracks" is
substituted for the former reference to "land
condemned under the provisions of [former Art. 96, §
20]", for clarity.

The first sentence of former Art. 96, § 5, which
enabled the United States to petition for condemnation
of land and to enter the land, is deleted as
unnecessary in light of § 14-101 of this subtitle,
which generally authorizes condemnation, and
subsection (a) of this section, which incorporates the
requirements of the Real Property Article. Similarly,
the first clause of former Art. 96, § 20, which
authorized condemnation and referenced former §§ 5 and
16 as to procedure, is deleted.

14-105. NAVIGATIONAL AIDS.

(A)  "NAVIGATIONAL AID" DEFINED.

IN THIS SECTION, "NAVIGATIONAL AID" MEANS A BEACON,
LIGHTHOUSE, OR OTHER AID TO NAVIGATION.

(B)  QUANTITY OF LAND.

THIS TITLE DOES NOT AUTHORIZE ACQUISITION OF MORE THAN 5
ACRES TO BE USED FOR A NAVIGATIONAL AID.

(C)  SUBMERGED LAND.

IF THE LAND THAT IS NEEDED FOR A NAVIGATIONAL AID IS UNDER

NAVIGABLE WATERS IN THE STATE AND AN AGENT OF THE UNITED STATES

SUBMITS TO THE GOVERNOR AN APPLICATION THAT DESCRIBES THE SITE,
THE GOVERNOR MAY:

(1)  CEDE JURISDICTION OVER THE LAND; AND

(2)  CONVEY ANY TITLE THAT THE STATE HOLDS IN THE

LAND.

REVISOR'S NOTE: Subsection (a) of this section is new
language added to allow concise reference to a
"beacon, lighthouse, or other aid to navigation".
