LAWS OF MARYLAND

Ch. 284

(A)   IN GENERAL.

WITH RESPECT TO LAND THAT THE UNITED STATES OR ANY OF ITS
UNITS LEASES OR OTHERWISE HOLDS IN THE STATE, THE STATE RESERVES
JURISDICTION AND AUTHORITY OVER THE LAND AND OVER PERSONS,
PROPERTY, AND TRANSACTIONS ON THE LAND TO THE FULLEST EXTENT THAT
IS PERMITTED BY THE UNITED STATES CONSTITUTION AND THAT IS NOT
INCONSISTENT WITH THE GOVERNMENTAL PURPOSE FOR WHICH THE LAND IS
HELD.

(B)  PREVIOUS GRANTS.

THIS SECTION DOES NOT AFFECT THE JURISDICTION AND AUTHORITY
OF THE STATE OVER LAND OR PERSONS, PROPERTY, AND TRANSACTIONS ON
LAND THAT THE UNITED STATES OR ITS UNIT HAS ACQUIRED ON OR BEFORE
MAY 31, 1943 TO THE EXTENT THAT THE STATE CEDED JURISDICTION
UNDER:

(1)  CHAPTER 193, §§ 3 AND 4, OF THE ACTS OF THE
GENERAL ASSEMBLY OF 1874;

(2)  CHAPTER 395, §§ 13 AND 14, OF THE ACTS OF THE
GENERAL ASSEMBLY OF 1874;

(3)  CHAPTER 67, § 21, OF THE ACTS OF THE GENERAL
ASSEMBLY OF 1900;

(4)  CHAPTER 743, §§ 2 AND 3, OF THE ACTS OF THE
GENERAL ASSEMBLY OF 1906;

(5)  CHAPTER 194 OF THE ACTS OF THE GENERAL ASSEMBLY
OF 1908; OR

(6)  ANY OTHER ACT THAT GAVE CONSENT FOR THE
ACQUISITION OF PROPERTY AND CEDED JURISDICTION WITH RESPECT TO
THAT PROPERTY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 96, § 47.

In subsection (b) of this section, the word "affect"
is substituted for the former word "restrict", to
reflect that former Art. 96, § 47 has been construed
as not affecting the jurisdiction ceded under former
Art. 96, §§ 28 and 36 before the enactment of § 47.
See 61 Op. Att'y Gen. 441 (1976) and 63 Op. Att'y Gen.
332, 333 (1978). This substitution and the additions
of the specific references to Chs. 193 and 395, Acts
of 1874, Ch. 67, Acts of 1900, Ch. 743, Acts of 1906,
and Ch. 194, Acts of 1908, and the general reference
to other enactments that cede jurisdiction permit the
decodification of former Art. 96, §§ 3, 4, 17, 18, 21,
28, 36, and 37, which applied only to acquisitions
before 1943.
