(2) THE BOARD OF PUBLIC WORKS MAY MAKE THE PAYMENT IN
LUMP SUM OR IN INSTALLMENTS.

(B)  WRITTEN OPINION.

THE BOARD OF PUBLIC WORKS SHALL STATE, IN WRITING, ITS
REASONS FOR APPROVAL OR DISAPPROVAL OF THE APPLICATION, INCLUDING
ITS FINDINGS UNDER § 12-405(5) OF THIS SUBTITLE.

(C)  JUDICIAL REVIEW.

A DECISION OF THE BOARD OF PUBLIC WORKS UNDER THIS SUBTITLE
IS NOT SUBJECT TO JUDICIAL REVIEW.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 78A, §
16C(b)(2), (3)(iv), the second sentence of (4), and
the first clause of (1), and the second sentence of
(c).

In subsection (a)(l)(ii) of this section, reference to
the "State budget" is substituted for the former,
incorrect reference to the "budget bill", since funds
that the Governor proposes in but the General Assembly
strikes from the State budget would not be available
for use under this section.

In subsection (b) of this section, the duty to "state,
in writing" is substituted for the former reference to
"a written opinion ... filed by the Board", to conform
to § 12-317(c) of this title and to avoid the former
word "filed" since the place where the opinion was to
be filed was not stated.

THE REVERSE OF THE STATE SEAL SHALL BE USED OFFICIALLY. THE
OBVERSE HAS NOT BEEN USED OFFICIALLY.
