(2) INFORM THE APPROPRIATE LOCAL GOVERNMENT ABOUT
PROBLEMS WITH ITS PROCESS FOR ISSUING A DEVELOPMENT PERMIT.
(E) RESPONSE OF LOCAL GOVERNMENTS AND STATE UNITS.
A LOCAL GOVERNMENT OR A STATE UNIT SHALL ACT PROMPTLY TO
REMEDY A PROBLEM THAT IS BROUGHT TO ITS ATTENTION.
REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 78A, §
57A(e)(2) through (4) and the second clause of the
first sentence of (e)(1).
In subsection (a) of this section, the reference to
issuance of development permits "by local governments
or State units" is substituted for the former words
"issuance of State, county, or municipal permits", for
consistency with the language used elsewhere in this
title.
Also in subsection (a) of this section, the former
phrase "known to or brought to the attention of the
members" is deleted as surplusage, since the Council
could not discuss a matter unless the matter is known
to it.
In subsection (b) of this section, the words "of
Economic and Community Development" are added to
modify the word "Secretary", for clarity.
In subsection (c) of this section, the duty to
encourage "State units" to participate is substituted
for the former reference to encouraging "departmental
participation", for clarity.
In the introductory language of subsection (d) of this
section, the word "appointed" is added to modify the
word "member", since the reference to the "member's
district" presumably excludes the ex officio members.
In subsection (d)(1) of this section, the defined term
"local government[s]" is substituted for the former
reference to "the government of the counties ... and
municipalities", to conform to subsection (d)(2) of
this section and the rest of this title. Similarly,
in subsection (e) of this section, the defined terms
"local government" and "State unit" are substituted
for the former term " [g]overnmental agencies".
