(2) "PUBLIC RECORD" INCLUDES A DOCUMENT THAT LISTS
THE SALARY OF AN EMPLOYEE OF A UNIT OR INSTRUMENTALITY OF THE
STATE GOVERNMENT.
REVISOR'S NOTE: This subsection is new language that
combines, without substantive change, former Art. 76A,
§ 1(b) and (d), since the former term "written
documents" appeared only in former Art. 76A, § 1(b).
and, therefore, a separate definition was unnecessary.
In the introductory clause of paragraph (1) of this
subsection, the word "means" is substituted for the
former words "shall include" and "means and includes",
which related to the form of the material and are
preserved, in paragraph (l)(ii) of this subsection, by
the use of the defined term "including". Therefore,
the former phrase "regardless of physical form or
characteristics" is deleted.
Also in the introductory clause of paragraph (1) of
this subsection, the former words "when not otherwise
specified" are deleted as surplusage.
Also in the introductory clause of paragraph (1) of
this subsection, the former specific references to
"book[s]" and "paper[s]" are deleted as unnecessary in
light of the broad reference to "documentary
material". Similarly, the former reference "other
written document" is deleted. This latter deletion
also avoids the inconsistency of referring to, e.g., a
"recording" as a written document.
In paragraph (l)(i) of this subsection, the former
reference to "any branch of the State government,
including the legislative, judicial, and executive
branches" is deleted as surplusage.
In paragraph (l)(ii)9. of this subsection, the former,
specific reference to a "sound recording" is deleted
as unnecessary in light of the broad reference to a
"recording".
