(1)  IS REQUIRED BY LAW TO BE OBTAINED FROM A UNIT;

(2)  IS NOT REQUIRED ONLY FOR REVENUE PURPOSES; AND

(3)  IS IN ANY FORM, INCLUDING:

(I)  AN APPROVAL;

(II)  A CERTIFICATE;

(III)  A CHARTER;

(IV)  A PERMIT; OR

(V)  A REGISTRATION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Art. 41, §
244(e).

In the introductory language of this subsection, the
word "means" is substituted for the former word
"includes", since the former word did not seem to
apply to the elements set forth in items (1) and (2)
of this subsection, but rather seemed to apply only to
the form. Thus, in item (3) of this subsection, the
defined term "including" is added.

(C) UNIT.

"UNIT" MEANS AN OFFICER OR UNIT THAT IS AUTHORIZED BY LAW
TO:

(1)  ADOPT REGULATIONS SUBJECT TO SUBTITLE 1 OF THIS
TITLE; OR

(2)  ADJUDICATE CONTESTED CASES SUBJECT TO SUBTITLE 2
OF THIS TITLE.

the first sentence of former Art. 41, § 244(a).

In items (1) and (2) of this subsection, respectively,
the references "subject to Subtitle 1 of this title"
and "subject to Subtitle 2 of this title" are added to
reflect that, because of the revision of parts of
former Art. 41, §§ 244 through 256A in Subtitles 1
through 4 of this title, the former definitions of
"rule" — now revised as "regulation" in § 10-101 of
this title -- and "contested case" no longer appear
