(2) A PARTY REQUESTS THE STATEMENT.

(D) LIMITATION.

FOR PURPOSES OF THIS SECTION, PUBLICATION IN THE MARYLAND
REGISTER DOES NOT CONSTITUTE REASONABLE NOTICE TO A PARTY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, § 251.

Subsections (a) and (c) of this section are revised to
state expressly that the agency is responsible for the
notice and any additional statement.

Subsection (c)(2) of this section also is revised to
clarify that a party must ask for the additional
statement.

In subsection (b)(3) of this section, the clause "that
is pertinent" is substituted for the former word
"involved", for clarity.

In subsections (b)(4)(i) and (ii) and (c) of this
section, the references to the "facts that are
asserted", "facts", and "facts asserted" are
substituted for the former references to "matters
asserted" and "matters", for clarity.

In subsection (d) of this section, the former,
specific reference to publication in the Maryland
Register under "§ 256P" is deleted, since former Art.
41, § 251 seemed to intend to preclude any use of the
Maryland Register for purposes of notice to a party.

10-206. DISPOSITION BEFORE HEARING.

UNLESS OTHERWISE PRECLUDED BY LAW, AN AGENCY MAY DISPOSE OF
A CONTESTED CASE BY:

(1)  STIPULATION;

(2)  SETTLEMENT;

(3)  CONSENT ORDER; OR

(4)  DEFAULT.
