10-204. PROCEDURAL REGULATIONS.

(A)  REQUIRED.

(1)  EACH AGENCY SHALL ADOPT REGULATIONS TO GOVERN
PROCEDURES UNDER THIS SUBTITLE AND PRACTICE BEFORE THE AGENCY,
INCLUDING THE RELATED FORMS THAT THE AGENCY REQUIRES AND THE
INSTRUCTIONS FOR COMPLETING THE FORMS.

(2)  A REGULATION UNDER THIS SUBSECTION MAY NOT:

(I)  GRANT THE RIGHT TO PRACTICE LAW TO AN
INDIVIDUAL WHO IS NOT AUTHORIZED TO PRACTICE LAW; OR

(II)  INTERFERE WITH THE RIGHT OF A LAWYER TO
PRACTICE BEFORE THE AGENCY.

(B)  PREHEARING PROCEDURES.

THE AGENCY MAY ADOPT REGULATIONS THAT:

(1)  PROVIDE FOR PREHEARING CONFERENCES IN CONTESTED
CASES; OR

(2)  SET OTHER APPROPRIATE PREHEARING PROCEDURES IN
CONTESTED CASES.

(C)  DESCRIPTIVE STATEMENT.

TO HELP PERSONS DEAL WITH THE AGENCY, THE AGENCY SHALL
SUPPLEMENT, SO FAR AS PRACTICABLE, THE REGULATIONS UNDER THIS
SECTION WITH A DESCRIPTION OF THE PROCEDURES OF THE AGENCY.

REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §§
245(a) and (b) and 251A(a).

In subsection (a)(1) of this section, the word
"related" and the clause "that the agency requires"
are added to modify the reference to "forms", to
clarify the scope of the requirement as to inclusion
of forms in the regulations. Similarly, the phrase
"for completing the forms" is added to modify the
reference to "instructions".

Also in subsection (a)(1) of this section, the former
language "[i]n addition to other rule-making
requirements imposed by law" is deleted as surplusage.

Also in subsection (a)(1) of this section, the words
"formal and informal", which formerly modified the
word "procedures", are deleted as unnecessary.

In subsection (a)(2) of this section, the phrase
"regulation under this subsection" is substituted for
