Item (2) of this subsection is revised to combine the
provisions of former Art. 41, §§ 244(f) and 250A(a)
and restate those provisions to clarify the apparent
intent of the clause of former Art. 41, § 250A(a) that
made "[t]he provisions of this act concerning
contested cases" applicable to "the grant, denial, or
renewal of a license". This restatement includes a
reference to "revocation, suspension, or amendment" to
incorporate former Art. 41, § 244(f), which defined
"[l]icensing" for purposes of former Art. 41, §§ 244
through 256A, although the defined term did not appear
in those former sections.

In item (2) of this subsection, the former words
"annulment" and "withdrawal" are deleted as
unnecessary in light of the broad word "revocation".

(D) LICENSE.

"LICENSE" MEANS ALL OR ANY PART OF PERMISSION THAT:

(1)   IS REQUIRED BY LAW TO BE OBTAINED FROM AN AGENCY;

(2)   IS NOT REQUIRED ONLY FOR REVENUE PURPOSES; AND

(3)   IS IN ANY FORM, INCLUDING:

(I)  AN APPROVAL;

(II)  A CERTIFICATE;

(III)  A CHARTER;

(IV)  A PERMIT; OR

(V)  A REGISTRATION.

REVISOR'S NOTE: This subsection is new language derived
without substantive change from former Art. 41, §
244(e).

In the introductory clause of this subsection, the
word "means" is substituted for the former word
"includes", since the former word did not seem to
apply to the elements set forth in items (1) and (2)
of this subsection, but rather seemed to apply only to
the form. Thus, in item (3) of this subsection, the
defined term "including" is added.
