REVISOR'S NOTE: This section is new language derived
without substantive change from former Art. 41, §
487(d) through (g).

In subsection (a)(1) of this section, the former
reference to a report "based on the evaluation plan
adopted ..." is deleted as unnecessary in light of the
references to the plan in subsections (b) and (c) of
this section.

In subsection (a)(2) of this section, the former
references to availability for "parties" and "the
public" are deleted as unnecessary.

In subsection (b)(1) and (3) through (5) of this
section, reference to the "governmental activity or
unit" is substituted for the former word "regulation",
for clarity.

As to the references to a "unit ... responsible for
the governmental activity under evaluation", see
revisor's note to § 8-406 of this subtitle.

8-409. HEARING.

ON OR BEFORE DECEMBER 14 OF THE YEAR BEFORE THE EVALUATION
DATE OF A GOVERNMENTAL ACTIVITY OR UNIT, THE EVALUATION COMMITTEE
SHALL HOLD A PUBLIC HEARING TO RECEIVE, FROM THE UNIT UNDER
EVALUATION OR RESPONSIBLE FOR THE GOVERNMENTAL ACTIVITY UNDER
EVALUATION AND THE PUBLIC, TESTIMONY AS TO THE EVALUATION REPORT.

for the former phrase "[b]efore December 15", for
clarity.
